Case Dismissed in Favor of Mexico
The husband filed a Petition for Dissolution of Marriage in the Circuit Court of DuPage County. Prior to the husband's filing the Petition in DuPage County, Illinois, the wife filed an action relative to the custody of the minor children in Mexico. The husband participated in the proceedings in Mexico and the parties agreed that the wife and children would continue to reside in Mexico. The wife moved to dismiss the husband's Petition. She claimed that the court lacked personal jurisdiction over her for lack of proper service. Moreover she argued that Illinois was no longer the home state of the children under the UCCJA. Judge Linda E. Davenport agreed and dismissed the husband's Petition for Dissolution of Marriage. The wife was represented by Emily A. Hansen of Botti Marinaccio, Ltd. The husband was represented by Maureen Sullivan Taylor and Joseph F. Emmerth, IV of Sullivan, Taylor & Gumina, P.C.
